Legal Question in Criminal Law in Ohio

possible sentencing for a charge

My boyfriend beat up my Ex boyfriend and is has an indictment for a second degree felonious assault. I would like to know the possible sentencing for this charge. He didnt use any weapons. My ex pushed him and my boyfriend punched him and they went to the ground. My ex had to get stitches on his nose. So Im just curious if he is looking at jail time and if so about how long.

Re: possible sentencing for a charge

As charged, your bf is looking at 2 years mandatory in prison. Many times prosecutors are willing to plea bargain to avoid the mandatory time, but a 2nd degree felony is the second most serious offense in the books!! Very serious....The crime is that your bf caused serious physical harm to someone else, more serious than your average assault. Even then, he's looking at 6 months, but it will ultimately be determined whether your bf was defending himself or the harm wasn't as great as they thought. Either of those will avoid a mandatory prison term.
