Legal Question in Criminal Law in Ohio
My son was arrested Friday night with posession of two grams of marijuana. He was arrested without his rights being read to him and they did not let him make a call until Saturday morning.
Bail was posted at $250. He is 18.

This message is not meant to: 1) contain my signature; 2) contain legal advice; 3) create an attorney/client relationship; or 4) guarantee confidentiality.
And your question is? You are probably wondering about the circumstances. First, unless they interrogate him, they are NOT compelled to read him his rights. Second, a phone call on Saturday morning does not violate any rights that I know of. Third, if it was indeed only 2 grams, this is the lowest misdemeanor which is punishable by only up to $100.
What I question is that bail was greater than the maximum sentence. Is he charged with anything else?
