Why is spitting in someone's face considered an M1 offense?

It's a part of your body hitting another person. It's an assault for which you can go to jail for 180 days. And you can be separately sued for money

Not only 180 days but a $1000 fine + court costs. Doubtful that these maximums will be invoked. Another reason the prosecutor wants to keep this charge is because he/she can offer a plead down to a lesser charge of perhaps an M-3 disorderly conduct. Thus, getting a conviction, and not trying it before a jury which may think this is silly.
