Legal Question in Criminal Law in Ohio
statue of limitations
My brother was arested 12/26/02 on a charge of possesion of crack cocain. He was first questionded in Feb. 200 for this and they releasedhim ad nothing was ever said about the crack cocain. Is there a time limit of how long they have to actually charge someone on something that was already plea bargined to in 2000?

The statute of limitations for a felony in Ohio is six years. This is not a statute of limitations problem. However, there may be a due process problem.

Your brother may very well be able to avoid prosecution, but I need to know exactly what happened the first time he was stopped on that charge.
