Legal Question in Criminal Law in Ohio

My Stuff is gone.

My wife and I moved some items to a friend house. He will not return them dispite repeated asking him. He says no. We ask him to set a date and he will not. We tell him we would like to come this date and he says no. So show up on the date anyway with police and he will not open the door. We asked him a final time, he says no, they puts it all out on the treelawn a 3am then tell us the same day at 9pm and says he watched everyone steal the stuff all day. Is this criminal or a civil matter, and does he have the right to do this to our stuff. He claims the stuff is abandon, which is not true. Because ever 2 weeks we are trying to contact him to get the stuff back. He either ignores us or says no.

This is not something that the police are going to get involved in. You can talk to them if you want to but I think that they will tell you that this is not a criminal matter. If the police do think that your friend's actions are criminal, they would punish your friend or have him pay a fine. That does not help your situation.

Your friend did not come to your house and take the items. He gained possession of them legally. If he still has some of them, you may be able to file a replevin action. If he does not, you can file a civil suit for money damages. You will have to decide if he has any assets that can be used to collect any judgment that the court may award you.
