Legal Question in Criminal Law in Ohio

theft in vehicle

Our car was towed from our house (arranged by the mechanic) to his shop to have the transmission fixed ---when we picked up the car it was at the end of the day...we noticed the next day that a 6 disc cd player was stolen.....can we withhold payment to this mechanic for the stolen cd changer......i called him and told him it was worth about $150 only to find out it is worth a whole lot more.........he paid $75 to calm me down and put on the check on the memo line THEFT??...does this admit guilt.. Do I have any options?

This is not at all how this is to be handled. You have to pay him for the work that he has done, and he has to pay you for your loss, but they are not to be mixed. You are both not following procedure, so it is bound to be messed up. You cannot cash that check or it will be considered settlement, and that is what he is trying to do. Talk to a lawyer or contact me directly.
