Legal Question in Criminal Law in Ohio
traffic violation
My son received a speeding and fail to stop ticket. He has been sick the last week, got cut from volleyball team and was not his self. His mind was not on driving. He has been driving for 1 & 1/2 years with no tickets. He generally doesn't speed. He understands the rules and outcomes. The officer trailed him and clocked with his car speed from a distance. He didn't use radar. My son says he really didn't think he was speeding byt his mind was not thinking about driving. If he was speeding he is willing to accept the outcome. Question? Should we go to court and pay fine or should we challenge the officers method of determining speed. He said 40mph in 25. Any advise would be appreciated. Thank You

As an Ohio Ticket Defense Lawyer, I say, "challenge every ticket." Here, even ifyour son was going 40 mph in a 25 mph zone,that speed may not have been unreasonablefor conditions and, therefore, not illegal.Also, there is always a chance that thepolice officer will not show up for court, inwhich case, the ticket gets dismissed.
