Legal Question in Criminal Law in Ohio

unlawful sexual misconduct with a minor

When I was 13 I had a relationship with a 20 year old and he was charged with unlawful sexual misconduct with a minor and put on probation for 5 years. Now I am 15 and pregnant with his child. He is being charged with unlawful sexual misconduct again only this time it is an F2. He hasn't been sentenced yet and I want to know what will happen to him. Both of my parents have told the prosecuter that they don't want to see him go to prison because they want him to get a job and support the baby. I there any chance of him not going? Do judges ever have an open mind about these things? Please help me. I just don't want my son to grow up without a dad.

Re: unlawful sexual misconduct with a minor

You should have thought about that when you were having sex with a 22 yr old man. THat aside, the judge does have discretion when imposing his sentence and may take your parents plea for mercy into consideration by giving him the minimum sentence.
