Sexual orientation jokes in the work place

I'm considering attaining a lawyer because of some jokes and the use of the word Fag in my work place. When or if my employer finds out that I'm seeking legal counsel, can I be fired?

You have to be real careful because if you are not in a union, then you may be fired at any time and for any reason, except a discriminatory one.

They can make stuff up after the fact...
