0.047 dui w/ failuar to controll

it is my first offence and i i swerved from missing a deer and drove off the road i had a light mixed drink and 1 12 oz beer 3 1/2 hours befor the accident am i gonna go to jail pleas respond soon

You are not guilty of a dui. It is extremely important that you get an attorney, either hired or appointed. If you take this dui now, and then twenty years from now you get a dui, you will be in jail for ten days. As it is as charged, you will be going for three days, either in a jail or in a hotel for an alcohol seminar. GET A LAWYER NOW! YOU ARE NOT GUILTY OF A DUI!

What offenses did they charge you with? If you were only charged with failure to control and not an alcohol related offense then you will not be going to jail. If they charged you with having a breathalyzer reading of .08 or higher or with Operating a vehicle under the influence (OVI) and you plead guilty, you may be going ot jail. If you are accurate on what you had to drink, you should not have been over the legal limit on a breath test. Having a drunk driving offense on your record is serious business and warrants having a good, experienced attorney to look the case over and make sure that all of your rights are protected. This will cost you more than you will want to pay but this is serious. Don't take it lightly.
