DUI and drug trafficking

I was pulled over for DUI and the police officer found marijuana and extra baggies in my glove box. The glove box was locked and my insurance information was in my wallet. I was under the impression the police were not legally allowed to do that. Could you please give me advice on how to handle this?

If a person has been placed under arrest, the officer may search the entire inside of the automobile, including the possessions of the driver.

If no arrest has been made but the officer has probable cause to believe there may be contraband (includes drugs), criminal tools (includes weapons), or evidence of a crime (includes possession of drugs) inside the automobile, the officer may search the entire automobile and the occupants inside.

Essentially, once a valid stop has been made, if the officer has probable cause he or she can search anywhere in the vehicle. The question in your case is probably whether or not the office had probable cause to search your glove box.

I recommend you meet with an attorney as soon as possible to fully discuss your stop and whether there was probable cause to make the search valid.
