You can be found guilty of a DUI offense even if you never took the breath test. The physical signs reported by the officer, including an odor of an alcoholic beverage, is enough to satisfy that element of the offense.
DUI is one of the most complex cases a lawyer faces at the misdemeanor level. I would strongly recommend anyone looking at the possibility of 180 days in jail, $,1000.00 fine, and loss of driving privileges, obtain the help of a competent attorney.
