Legal Question in DUI Law in Ohio

after being found not guilty on a ovi/refusal bac /and reckless op charge/ how do i get my license back im being told that the suspension for a year still stands even though i wasnt driving anything and found not guilty Whats wrong here

In Ohio, you or your attorney needed to file an ALS appeal arguing that there was not reasonable grounds for the police to pull you over and ask you to blow into their machine. If there were reasonable grounds though, you will lose your license for the year for refusing to take the test, regardless of whether you beat the OVI.

It is Orwellian, but that is the way the law is written. They get away with it because the say that the one year suspension is not a punishment since you have no right to drive in Ohio (rather it is termed a "privilege").
