The penalties for OVI vary from Court to Court. The minimums are set by the State laws and municipal ordinances but the Judge is not obligated to give you the minimum.

Is this your first OVI charge? If not your first, how long has it been since your last one? Did you take a breathalyzer? If so, what was the reading?
