ohio omvi law
my friend was arrested for omvi, she did not refuse a breathylizer, infact she took it 4 times and all four times result came back non-conclusive. Also her court is not in 5 days but instead 7 days. i read the law and and it states the court date should be in 5 days not five business days. what should she do or what should i tell her to do ?

Your friend should get an attorney. She needs to plead not guilty at the initial hearing, let the court know that she is going to get an attorney, if she has not already hired one. The fact that the breathalyzer was non-conclusive does not mean that they will not be able to show that she was under the influenc but it does mean that she should have an attorney to check things out. OMVI laws are strict and the consequences of being convicted are very harsh-both on the short and long term. If there is a legal way to keep this off her record she should try to do it. It won't be cheap to get an attorney who knows what he is doing but cheap is not what you should be looking for. If you are going for cheap she might as well go in and plead guilty.
