Legal Question in DUI Law in Ohio

I was pulled over 01/08/10 by Twinsburg, Ohio Police. I was asked if I had been drinking which my reply was no. I had not been feeling well and drank some cough syrup prior to driving. I was given a road side test, was unable to raise my leg for allotted time period. I was brought into the police department where I was given a breath analysis test. It should I had a B.A.C. of .099, I was not intoxicated enough to were I was unable to drive. How bad is this charge?

You're over the limit and technically guilty no matter what caused it. Of course, there could have been something wrong with the machine or the sample.....it's not too bad if it's your first offense....3 day alcohol seminar and probably a $500-750 fine....a lot depends on where you are charged as well....it can be worse....call me directly if you want....216.952.1990
