Legal Question in DUI Law in Ohio

Required to pay reinstatement fee??

About 5or six months ago i was charged with ovi, improper change of course, and bac . After going to court and pleaing not guilty the officer failed to appear for any of the trials. Therefore the all charges were dismissed without predjudice. When I contacted the bmv they said my license still said terminated and I would have to get the court docket and take it all the way to the reinstatement office and may have to pay $450 to reinstate my driver's license. I was wondering why I would have to pay a reinstatement fee since all charges were dismissed(''without predjudice'') including the bac charge. Thank you I hope someonecan shed some light on this.

If in fact all of the charges, including the administrative suspension, were dropped there should be no reinstatement fee. The BMV should agree with that when you show them a copy of the docket entries. If not, you may have to get an attorney to straighten it out. You should definitely try to work it out yourself first.

you can be found not guilty or have the charges dismissed but the ALS (administrative license suspension) that was sent to the BMV for your refusal or high BAC will remain in effect unless the judge ordered it withdrawn.
