Legal Question in DUI Law in Ohio

Underage Consumption law 4301.631 orc

Under this code in the ohio revised law code it says that ''underage person'' refers to someone under the age of 18, i was charged with this offense but i am 19 years of age. Does this give me any chance of nulifying the charge because of my age being beyond 18, or does the fact that they never tested me for blood alcohol content. what are my options?

If you are 19, you can't be guilty of violating R.C. 4301.631, which prohibits the purchase or consumption of "low-alcohol beverage" by persons under eighteeen. Are you sure that's what you're being charged with?
