Underage dilemma
i was recently at a bar one night wiht some fiends and i was sitting at the bar while we were waiting to leave and an officer approached me and asked me and my friend for our ids. He is 23 and i am 20. They then searched me and asked me to walk outside (they did not however use handcuffs). I wasnt drinking when they approached us and i wasnt even holding the drink. I had been drinking in the bar earlier but not when i was sitting at the actual bar. They gave me no sobriety test at all so they have no proof of alcohol in me. I dont exactly know what i can do but i dont believe i am totally i the wrong here. I am just realy worried about the entire process.

Were you charged with underaged drinking? They would then have to prove that you were and that would be difficult. Underage drinking is a potential 6 month jail sentence, not that that would happen but it is very serious. Get a lawyer to get you out of it.

IF you were charged with underage consumption, they have to prove that you were actually drinking. It appears that the only way they can do that at this point is by officer testimony IF he witnessed you drinking earlier. ENter a not guilty plea at your initial court date and retain a lawyer.
