Legal Question in Elder Law in Ohio

guardianship of 90 yr old mother

My 90 yr old widowed mother is not

paying her bills ( due to forgetfulnes)

not responding to her mail i.e.

insurance request forms to receive

payment from my late father,

declining health. Though not easy,

my siblings ( 1 is not in agreement)

feel we need to file guardianship.

How do we do this? Thank you

Is your mother living in Idaho or Ohio? A guardianship is set up through the Probate Court for the county that the ward (your mother) lives in.

If your mother is legally competent, that is she understands what it means to sign a power of attorney, you may want to consider having her sign a durable power of attorney. If she is living in Idaho, then you should consult with an attorney licensed in Idaho.

You will need written verification that your mother is in need of a guardian, either for her 'person' or her 'estate' or both by a physician or social worker. Probate court has the proper forms to fill out. Once the papers are filed, there will be a hearing at which time the guardianship would be granted. Have you considered the simpler route of asking your mother to grant her children power of attorney?
