mother's house

My mother is elderly and has a brother living with her. Me and my siblings want him out because of health issues. What can we do to get him out of her house.

If your mother owns the home and she is not under a guardianship, then she is the only person who can order your brother out of the house. Your best bet is to try to reason with him-explain your concerns. You probably have already done that without success.

If mom is not able to care for herself or if there are other grounds for her to be declared incompetent, then a guardian could be appointed by the probate court. That person would be able to make decisions about the use of her property and what would or would not be in her best interests.

Your best bet is to talk directly to an attorney. A guardianship can be complicated, especially in a situation where mom or one of her children does not think it is necessary.
