abandonment

i have full legal custody of my 3 year old almost 4 year old son. his mother took off when he was 1 and only pops up every 6 to 8 months. she is with an extremely violent man who has already been arrested for beating her and has a history of this behavior. i receive not support or even a call to check on him. she abuses drugs and alcohol and is very unstable. in order to protect my son from ever being drawn in to this life style of his mothers i would like to file for abandonment to insure she can't try to take him and put him in any danger. i will always agree to let her see him as i have been doing under my terms in my house. i would like to avoid her trying legally take him disappear and out him in danger. would never in any way keep her from him i haven't to this day. it has been her choice to not be a parent o she is moving in and out of the state another reason she's away for long. how do i go about filing for abandonment and is my case strong enough?

I believe you would ask the court for full custody and supervised visitations. If you are attempting to completely shut their mother out of their lives and yours, this probably won't happen.

With evidence of all the behavior you described, getting full custody with no visitation on her part should be really easy.
