Legal Question in Family Law in Ohio

Abandonment

(Where do I start) On June 17, my husband came home and packed his stuff and left. He simply stated he was ''unhappy'' and did not want to be together anymore. We have a baby on the way. He is due August 19. Because he left and I am unable to work because of the baby, I was evicted from my apartment. So, now I am living with his parents until I am able to work...

Right now, he is not invovled with the baby. I am setting up his room and buying everything he needs.

Recently, I expressed to him that I was not comfortable with the baby going to his home because I've only been there once. I asked if I could come in so I could see that he has everything he needs for the baby but he says no. He says I'm invading his privacy.

We did agree to have 50/50 custody with me as the primary cusody holder.

If I am uncomfortable with Caleb going to his dad's home, do I have the right to say no until I am ready? He does have 100% access to my home.

If he was to take Caleb to his home and does not return him when asked, is that kidnapping?

What can I do at this point to protect myself and my son?

Thank you for your time!

Re: Abandonment

I am assuming that the two of you are still married. If that is the case, then you both would have equal rights to the child unless there is a court order stating otherwise. If you have that fear, you can contact me to discuss the matter further.
