Adoption question
I currently have custody of a 2year old child in which I am not related to, her mother is serving a three year prison sentence. She was an aquaintance and contact has been limited over the last year. My husband and I would like to adopt the child. The mother wants her back upon her release. My custody was granted through Juv. Court. Would her mother have to agree to the adoption? What are the chances of her regaining custody after a three year seperation?

The mother must be served with the adoption petition, as well as the biological father, if known. As to your chances, that depends on the facts before the court as to the amount of contact and support provided by the mother while in prison. The court is guided by what is in the overall best interests of the child.
