What is the best way to approach a child endangerment charge if you have proof and signed witness afadavits stating that the vehicle was still in plain sight and you were only away from the vehicle for 5 minutes? The person has no record whatsoever and the child was never in any danger. He was sleep when she left the vehicle and walked approximately 50 feet away to drop off her dog. While away, the child (1 yr of age) woke up and began crying. Someone driving by heard the baby, did not see anyone, and called the police. The police and the mother arrived at the vehicle at the same time. The police allowed the woman to call her husband. He arrived within 15 minutes of the incident and was allowed to take the child. The police never asked the gentleman for identification therefore it is assumed the incident wasnt that serious, otherwise they would have contacted children and family services.
