Legal Question in Family Law in Ohio

Bankruptcy and Divorce

My wife and I are filling out the asset and liabilities form for a dissolution of marriage. In the spaces where it asks for a listing of debt we are unsure whether we should put anything there since we currently are not paying on debts as we are going through bankruptcy proceedings as well. Do we have to list debts on this form even though we will have those debts discharged through a chapter 7 proceeding?

Re: Bankruptcy and Divorce

You should indicate your insolvency. Usually courts wait for resolution on bankruptcy before granting the dissolution or divorce to be able to determine what actually has happened to the assets and debts.
