Legal Question in Family Law in Ohio
Blood relative custody question
My cousin's 11 year old daughter (and her parents)
would like her to move with us to help the family
out financially until they can get out of a poor
and dangerous neighborhood, and for her to go to
Catholic School in our area next year. What legal
documentation is required for her to be able to go
to this school and live with us? I thought I read
(Ohio law) somewhere that since we are blood
relatives that all we need is a notarized
agreement of ________ (physical custody?
guardianship?) and we don't need to go through
the courts. We also will not need to go through
the courts to prove the parents unfit or anything?
So I don't know how legal we need to go with this.
My true question is: what will the Catholic school
require legally for her to attend, and what
documentation is needed to make us temporary
guardians. Tha

The best advice I can give is to ask the administration what they require. Public schools have certain requirements that in most cases require the legal custodian/guardian maintain a residence within the school district. However, I doubt the parochial school has any such requirement. What they probably will want is some documentation assuring them that they are dealing with a legitimate custodian. So it would behoove you to have a consent form signed by the parent allowing you some power of attorney to deal in their place with the school. I would ask the school to tell you exactly what they need such as a transfer of records from the previous school, etc.
