Legal Question in Family Law in Ohio

calculation of child support

1. My divorce case was done last year. Now, my wife wants to review and recalculate the child support. My question: if I remarried, does my current spouse's income will be combined with my income as a base to calculate child support?

2. My ex-wife said that she will quit the job and let me support her everything and will increae the child support fee. Could she do that?

Re: calculation of child support

1) The second spouses income is not included in the child support calculation.

2)Your ex can quit her job, but the Court will look to the reason why. Did she quit just because she felt like it or to be punative to you or did she quit because she was laid off or the demands of raising the children were too hard. If her termination was voluntary on her part, then the Court will impute her income into the formula, if her termination was due to circumstances outide of her control, then her income will be deducted from the formula. The diference should be nonconsequential in any event.
