Chances of father getting custody of minor child

My husband's ex-wife talks bad about my husband in front of their child while he is on the phone with her. When the mom calls on his visitation weekends she tells her to tell her dad she wants to go home and this upsets the child. She is also re-married to a man who spent time in prison for domestic violence. If we went for custody would we have a chance to get it? Thank you

Based on what you say, the Court would look seriously at a change in custody. The items to emphasize are the domestic violence especially if it was against a child and the faact that his ex is discouraging visitation.
