Where can I find a legal definition for (substantial change of circumstance)in reference to Title 31 3109.05(5) para 3. Twelve months subsequent to final decree, CSEA is recommending that my support obligation be augmented predicated upon the fact that the child I have custody of reached the "age of majority". Said child continues to live at home while attending UC Medical School for which I solely shoulder the financial burden.(ex has two children)

Re: Change of Circumstance

I am not sure where you got the citation. The syntax is not quite correct and there is no section I can locate to match it. The problem is 3109.05(5)is not possible. Statutory citations generally follow outline style--If you start with a number then the next division is a capital letter followed by a number followed by a lower case letter. A minor point, in ohio you don't need the "title" just "ORC" for Ohio Revised Code and the section number.

I was able to find a statute that does set out the criteria for both setting and modifying child support which includes the work sheets and tables. I would send it but going through the electronic text grinder, the tables will probably get completely jumbled. The citation is ORC 3113.215. You will find that in Title 31. I don't know where you are or what your resources are. But I believe that most regular libraries carry the revised code. You can also get the sections over the World Wide Web in a number of places. However, it is best to go to the official codes because after each statute are usually lengthy annotations that include summaries of court cases that can be quite helpful in addition to cross references etc.

If you can't locate it, I will e-mail you the text but won't guarantee how much of it actually gets to you in a form resembling human language.
