Change daughters last name

I wanted to know what I needed to do to change my 6 year olds last name.Her biological father has been in and out of her life and she does not want anything to do with him she has been asking if I can make her last name to what mine is which is my married name her step fathers last name.Can I change it to my married name or does it have to be my maiden name also do I have to have the biological fathers consent to do this.Thank you .

You must apply to the probate court in the county where the child currently resides. The biological father is entitled to notice of the hearing, and can object to the name change, but the court will determine whether such change is in the child's best interests. A 6 year old is too young for his/her wishes to carry any weight legally.
