Change in Visitation...

I have residential custody of my two daughters (10 & 16). We live in Maryland, however our custody agreement was put in place in the Ohio courts. My question is this - My 16 year old does not want to spend the entire 6 weeks in Cincinnati that our custody agreement states. She has a job, sports and social activities crowding her schedule and would like to go in for two weeks as opposed to six. Is this legal or do I have to file a motion through the courts? (My 10 year old will be going in for the full 6 weeks.)

It is very common that, as children get older, they develop actitivies outside the home that are very important to them and they don't want to have to give up. I think that if you cannot work out an informal arrangement with her father that takes this into consideration, you may have to have visitation modified through court.

I don't know the particulars of your custody agreement but your best option is to go through the court just to be on the safe side. Or have your 16 year old talk to the other parent and see if she can get his approval.
