My daughter�s father and I were never married.

However I am married now with other children.

My question is, if something were to happen to me (death), what steps can I do now to ensure that my daughter would stay with my husband

A parent has a legal right to custody of a child unless there has been abuse, neglect, or custody is not in the child's best interest. To try to avoid lengthy and costly disputes, your wish to grant custody to the child's stepfather upon your death should be written into your will. You may also look into a legal adoption, where the child's father gives up his rights as a parent.
