Child Support Arrearages

I was receiving child support for two children. For

four years obligor's salary increased by 30%. I

requested hearing for modification of CS. No

action was taken. Also child support was

terminated without my consent. I am asking the

court to reinstate child support and also to claim

arreages from the increase in salary for four

years. What is the judicial authority for this claim?

You can get a support order effective as to the date of filing, not back-dated four years.

I'm not sure why support would be terminated. Perhaps some part of the story is missing here.

Support is based on the income of the two parents, with such things as work-related child care expenses, health insurance for the child and visitation credits. The court doesn't take into account the other bills of the parents.

Something in this picture is missing. The only reason that support would be reduced is if it is in the best interest of the children, the obligor lost his job, or the children are either 18 or have graduated from high school.

The squeaky wheel gets the oil. You need to contact CSEA and make sure you get an acceptable answer as to why the support was terminated and why there was no judgment entered on the arrearage. You may need a lawyer to cut through the red tape.
