Legal Question in Family Law in Ohio

child support fraud

Hi I just recently found my father and have been communicatiing with him. I just found out that my mother had been recieving child support from him, but I never lived with her. I lived with my grandparents all my life and they supported me. I am trying to find out what I should do to get the child support dropped. I do not want my father to have to pay child support anymore. And I would like to know if there is anything I can do about my mother recieving child support for me when I never lived with her. please help!

Re: child support fraud

If you did not live with your mother she did not deserve to receive child support for you. Your father at any time could have asked the Court to review the situation. He did not and has waived his right to do so. Niether you or your father can collect it back from her. Your father may, have a civil action for fraud against her. He would have to prove that she defrauded him and the Court in representing that she provided the majority of your support. If your grandparents covered for her by actually housing and feeding you for her, then this is not fraud, especially if your dad always knew it.

In sorry I could not tell you what you wanted to hear.

Good luck.
