child support??
my ex husband and i have shared parenting. we have written in our divorce that he pays up to $100 per week for any child care expenses which he never does. I do not have a child support order and he makes most of his money under the table so if i try and take him to court for child support he would end up not having to pay, or worse me having to pay him. could i try and get full custody and child support or is there any way that I can file him in contempt for not paying what he is supposed to have been paying and get my money back? i have tried calling the hamilton county court of domestic relations and they just keep telling me it's a child support issue and connect me to child support but then they tell me i don't have a child support order so i would need to file for one. any help would be appreciated. thanks

You could file for sole custody. That is an option. You should get a support order put on. There are ways of tracing income, even if he recieves no paycheck. He must have a bank account. He also has to have expenses that he pays somehow. You could report him to the IRS. I believe they will give you a finders fee if the prosecute him. They will also dteremine his income level in their investigations. Best regards, Edward DiCato
