Legal Question in Family Law in Ohio

college costs of an emancipated child

My divorce agreement from Ohio states that my ex-husband is responsible for college tuition, reasonable expenses, and housing. He paid this when she was 18-19, before she dropped out of college. My daughter, age 25, and I reside in NJ where she is a full time student. My ex-husband claims that he is no longer legally obligated to financially support her education. Please advise

Hey may have a point, but he cannot, by himself stop paying. I suggest you get an attorney to look at all the issues and advise you as to what you should do. My consultations are always free, so call me at 732/247/3340 and we'll discuss the case. Then I can give you a good answer and what your options are.

Good luck!

Your daughter sounds like my son, 19yrs. College interrupted.

Your ex-husband's obligations will be controlled first by the agreement you and he made at the divorce. Have a lawyer look at it, and advise you. The law of the state (and I am not sure if it is Ohio law, but probably) will also affect it.

There is a lot of money involved, so you really need some expert legal advice. And this is his child too, so legal obligations is not all that there is between him and his daughter.

If you would like, give me a call; I am in northern New Jersey. The telephone consultation will be free. I would be happy to help you out.

Re: college costs of an emancipated child

It all depends on the language of the separation/property settlement agreement. If the obligation to pay for college, under the agreement, ends with emancipation, independence combined with adulthood, then the obligation to pay for college no longer exists because she left school and apparently went her own way. She had a scholarship funded by her father and apparently did not realize the value of what she had.
