Legal Question in Family Law in Ohio

Concerened Grandparent

My son is a military officer. Was stationed in N.C, now moved to Virginia. He has a permanet address in Ohio drivers license from ohio and pays Ohio Taxes. While on deployment his wife left their residence in N.C with their 2 year old daughter. Informed him she did not want to be married any longer. She spent over $20, 000 while he was gone. Upon his return home, he filed seperation apers in N.C. Agrrement was that he would have his daughter for 3 months and then his wife would have her for 3 months. When time wasd ue for the mother to get daughter, she told him to keep the child. He has had her now for 5 months and mother is stirring that she now wants child. Mother is not really able to give child care like the father. He is considering filing for divirce but also wants custody of the chiild. Question is what is his leagl status in Ohio( can he file for divorce in Ohio)? And what is his legal probability of getting custody of the child. Probelm is he is not stationed in N.C. any longer and has not been in Viginia long enough to do anything.
