contempt of court motiom

there is a contempt of court motion for not paying suppousal support for 3 months I live 740 miles away I have no other income can it be heard in court without me being there and can it be heard right now

In British Columbia the contempt motion will be heard at the court where the action is situated unless a Judge orders it to be heard elsewhere. It can be heard without you being there in the sense that if you do not go, it will be heard anyway, but you run a very real risk of being seen as being even more contemptuous of the Court. Contempt is very serious and may result in a fine or imprisonment or both. You must consult a lawyer immediately. If you can not pay for a legitimate reason then you should apply to vary the support order, but bear in mind that if the order is for the amount specified in the Child Support Guidelines for your gross income, then by definition you can afford to pay - child support takes precedence over all other obligations, even pre-existing debts such as car payments.
