Legal Question in Family Law in Ohio

Can credit cards be transferred to an exspouse's nameif the divorce court orders

If an exspouse is ordered by a divorce court to pay for a credit card, which is in the other spouse's name, can that credit card be transferred to the exspouse's name? Can the credit card issuer be forced to transfer the card to the exspouse's name if he/she has been made responsible for that card per the divorce court ruling? Can the card be canceled then transeferred to the ex spouse's name. I have this situation and I am afraid that my exspouse will not pay the payments therefore ruining my credit. Can anything be do in this situation? Thank you.

The divorce decree cannot alter the rights of third party creditors such as a credit card company. While you may request the divorce court to order the your ex transfer the cards into his/her name, it unlikely you will prevail (though if he's been making the payments, then the cc company may do the transfer anyway) . The divorce court does have continuing jurisdiction regarding those debts. So if he/she does not pay you can file a contempt action in the divorce court.
