Legal Question in Family Law in Ohio

CSEA error costing us

My husband got custody of his son in Jan.'95 but the CS order didn't stop until Apr.'95. He had overpaid $1140 at that time. He is now being billed that amount by the CSEA in error, but we have no idea how to get a judge to see this case. What kind of motion do we file to be able to see the judge and show him the proof that we don't owe this money. CSEA says they can't help. They have said that their computer shows a court order from 10/97 saying that it was owed. They can't find the order and we have no such order. Can you help?

Re: CSEA error costing us

You merely have to file a motion to modify child support. Take the caption(the top part of your pleading) from your decree and in the body just state that you want to modify support. If both parties agree an attorney can shortcut the process, by filing an agreed entry.

Good Luck!!!!
