Custodial rights

My sister is divorced. Her daughter is being emotionally abused by the ex-husband. He has now started pushing my niece around. My niece does not want to go to her father's during his custody days, but is afraid her 13yr old brother will become the object of her father's ire. How old do kids have to be before the courts will let them choose not to see their parents on custody days? We live in Ohio.

The age varies. The Courts usually try to determine whether the children are able to adequately reason out what is happening. The son seems the proper age. You don't mentions the daughter's age.
