Custody of child, non-married parents

I am a father of a newborne , his mother and I arent married, but we do have a written agreement on custody, that was signed and notorized, if we seperate. Is this agreement a binding contract, if it isn't filed in Juvenille Court? and if not, do fathers have any rights in a seperation , or do mothers get top priorety?

I suggest that you have this agreement filed with the court. The court will have a record that both parents can fall back on if necessary, and both parents' right and responsibilities will be enforced.
