Custody of minor child

My sister in law passed away leaving one daughter. She was not married to the paternal father. Her will and testiment requested custody be awarded to the daughters grandparents or her sister. The courts ignorred and granted custody to the paternal father. The father remarried and subsequently divorced. Does the ex-step mother retain any rights for visitation and/or custody?

The paternal father has been convicted for various criminal items (DUI, tax evasion, CPO violations, etc). My wife and I (Aunt and Uncle) wish to petition the courts again for custody?

The court would look to see what is in the best interest of the child. If you petition the court, the court may find that you and your husband would do the best parenting for the child at this time.
