Custody Motion Hearing
Although paternity was established and a support order was in effect there was no visitation order in effect, but my son's attorney had been working on joint custody papers and it was agreed when my sons ex-girlfriend returned from her vacation in California she would sign the papers.
We found out that she was planning on taking the child and fleeing before the papers were signed.
My grandson's mother was on her way to take my
grandson out of state, we found out and my son had her served with a custody motion in the nick of time.
The motion is set for hearing 11/26/01. My question is:
What if she does not appear at that motion for custody/visitation? What recourse does my son have?

If she fails to appear for the hearing, she is going to be stuck with whatever the court rules, or more likely, whatever your husband's attorney presents to the court for visitation.
