Custody Question

Would an affair impact a custody? I cant really prove anything other than circumstantialy, but my wife had an affair.. we are getting a divorce and have a GAL involved in the case. I am seaking joint custody with a 50/50 time split, we are both good parents, and Im trying not to let my feelings for impact anything. She is wanting significantly more time with them. we live close and work close. Is a spil time typically preferred? im in delaware cnty. Any advice would be great I'm really worried im going to lose my little girls.

Re: Custody Question

The affair may not impact custody. The court looks at what's best for the children. What is taken into consideration is their ages, the commuting distances parents live between each other, the activities of the children, essentially, how beneficial it is to split their time equally. But split custody is not impossible. Have you discussed this with your attorney? It's good to keep emotions (negative) at a minimum.
