Legal Question in Family Law in Ohio

custody rights of non-custodian parents

my son has custody of both of his daughters.Their mom never showed up for the hearing as she was un unfit mother. The girls are l2 1/2 and 14 1/2. Their mom moved away to Utah about 4 or 5 years ago. She married a guy from Utah, He got a divorce when she was having an affair, she married a guy from south america, lived there for the past 2 years. Now, back in Ohio, she wants to see the girls every other week-end, summer time, etc. The girls are older and don't want to go as they have their own things to do with their friends, are involved in church and other activities. They don't really know her, the oldest, doesn't want any thing to do with her. The mom lives 70 miles away. She never paid child support until my son found out she got a job. She is getting $50.00 taking out of her pay (every 2weeks) I believe. This started about a month ago, that is why now, she is persuing to get the girls these other times. Can she do this?Does my son need to get a lawyer, what chance does he have to not let the girls see her all these times? She never cared before but now that she has to pay some-thing she is starting this.

Re: custody rights of non-custodian parents

It's kind of predictable. It often happens that when a child support order goes on, the formerly uninterested parent suddenly gets interested. Probably revenge. But if it goes to court there is a good chance she will get some form of visitation. Unless there is a real good reason to cut off communication altogether, the court will probably order some type of supervised visit (depending on the age of the girls and the situation with the mother) and then quickly go to unsupervised.

Definitely get a lawyer for this and try to follow his/her's advice.
