Legal Question in Family Law in Ohio
My daughter shares custody via shared parenting for her 18mo.old son. She wants to move to another state. If the ex does not agree with this, is she allowed to move the baby away?
1 Answer from Attorneys
Her ex would need to file a complaint with the court in order to keep the child in the state. However, he would need to show a good reason for why the child needs to stay in the state and why he cannot visit the child in another state.
Has he filed a complaint with the court or threatened to do so? Where does your daughter want to move? Does she have full custody? Does the ex pay child support?
