I am divorced and remarried.

I no longer qualify for EIC tax credit. My income however is less than min wage, but my current husband has a income of 70,000+.

Can I request a hearing for the judge to modify the current order for tax deductions based off of my current filing status? The non custodial parent is Not paying heathcare as ordered in the divorce decree & we also care for the children 80% of the year.

Child support and parenting issues are modifiable based on changes of circumstance. You certainly can request the court to review your proposal for a change, but you should have the request figured out in advance and in the best interest of the child.
