Disillusionment of Marriage and Child Support
My wife and I are going through a disillusionment of our marriage. She claims she is not going to pursue any sort of child support. In a disilluision both parties have to agree to everything. If we agree on this no support clause is this possible? My name is also not listed on the birth certificate. I cannot find a straight answer from anyone. Please help!!!

Re: Disillusionment of Marriage and Child Support
Parents in a divorce cannot choose to forego child support without the permission of the court. The court would want to see what you would owe and what it is you both plan to do in place of a standard support order. I suggest you consult with a domestic relations attorney.

I would have to have more facts before I can give you a straight answer. If you are afraid that she is going to say she will not seek child support and then will turn around and attempt to seek it then you definitely need to speak to an attorney. Please feel free to contact me for a free consultation.
